General Terms and Conditions (GTC)

FAHRPOOL is an online service of Ayano GmbH, Ibelweg 18a, CH-6300 Zug, hereinafter referred to as "Ayano".

1) Changes to the GTC

These General Terms and Conditions (hereinafter referred to as "GTC") were last updated on November 22, 2022. Ayano reserves the right to amend the GTC at any time without prior notice. The latest version of the GTC can be viewed at the following link https://fahrpool.com/terms

2) Object

With FAHRPOOL, Ayano operates online services that enable users to organize carpooling to events.

These GTC govern all rights and obligations between Ayano and the users of FAHRPOOL's services

By using the services of FAHRPOOL you accept these GTC. If you do not agree with the GTC, please do not use the services.

2) Warranty

Ayano provides its services with due care and in accordance with the current state of the art. However, availability at all times and freedom from errors cannot be guaranteed. Ayano’s liability is governed by statutory provisions. Liability for slight negligence is excluded unless material contractual obligations (cardinal obligations) have been breached. Liability under mandatory statutory provisions, in particular under the General Data Protection Regulation, remains unaffected.

Ayano provides technical support on a "best effort" basis and only in response to requests via the contact form. Ayano does not guarantee the availability of technical support.

Ayano reserves the right to permanently or temporarily discontinue, remove or modify the Services (or any part thereof) or add new Services at any time. These changes are automatically subject to these Terms. Your continued use of the Services following such changes constitutes your tacit acceptance of the changes.

3) Who may use the services

The services of FAHRPOOL are basically open to all users.

5) Registration

No registration is required to use the FAHRPOOL services. The administration of the ride pools takes place via secret "admin links". Self-generated content such as carpooling opportunities and registrations for carpooling opportunities can be edited and deleted by users without registration. Users are uniquely identified by means of cookies.

6) Price

The services are in a test phase and are free of charge during this time. However, Ayano reserves the right to charge for the services (or parts thereof) at a later date.

7) Termination

FAHRPOOL users do not have a user account, so no termination is required. However, you can delete the data stored about you yourself at any time or have it deleted by the owner of the "Admin link".

8) Data protection

9) Applicable law and place of jurisdiction

The ordinary courts in Zug (Switzerland) shall have exclusive jurisdiction for all legal disputes arising from this contract.
